SITE OWNERSHIP
The MUSTOCALZATURE.COM website and all its contents are managed and maintained by the company Musto Calzature srl with registered office in Milan, Via Piccinni n.4, with CF and VAT no. of REA of the Company Register.

Access to the site and use of the MUSTOCALZATURE.COM site as well as the offer and sale of products through the MUSTOCALZATURE.COM site are activities regulated by these general conditions of sale.

Access to and use of this website as well as the purchase of products on MUSTOCALZATURE.COM presuppose the reading, knowledge and acceptance of these general conditions.

By accessing the MUSTOCALZATURE.COM website, users undertake to accept and comply with all contractual conditions contained in this website.

OBJECT
 The MUSTOCALZATURE.COM website provides the user with a virtual showcase of footwear, leather goods and accessories that can be purchased online.

By placing an order online in the various ways provided, according to the order form on the Site (hereinafter the “Order”), the Customer (i.e. the individual, natural person, who makes the purchase on the site, not attributable to his/her commercial, entrepreneurial or professional activity) declares that he/she has read all the information provided to him/her during the purchase procedure and that he/she fully accepts these general conditions (hereinafter the “Conditions”).

The contract stipulated between Musto Calzature srl (hereinafter “Musto Calzature”) and the Customer must be considered concluded with the acceptance, even partial, of the order by Musto Calzature. In this way the Customer undertakes to purchase the chosen product with the selected characteristics and, consequently, to pay the relative price. The transmission of the order is binding except for the exercise of the right of withdrawal. In the event of non-acceptance of the order, Musto Calzature will in any case provide timely communication to the Customer.

Musto Calzature will then take care of shipping the purchased product to the address indicated by the Customer at the time of purchase.

PURCHASE METHODS
The products offered for sale by Musto Calzature are only those present on the Musto Calzature website at the time the Order is placed, as described in the relevant information sheets.

In any case, it remains understood that the images accompanying the description of a product are for information purposes only and may not be perfectly representative of its characteristics but may differ, for example, in color and size (also due to the browser and monitor used to access the Site and view the images).

To place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it after having carefully read the General Conditions of Sale, as well as the characteristics of the product and/or products that he/she intends to purchase. The Customer must also request Musto Calzature, if desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 DpR n. 633/1972.

Musto Calzature will confirm the order within 48 hours of receiving it, once the actual availability of the product in stock has been verified. In the event that the product is out of stock or no longer available, Musto Calzature will promptly notify the Customer at the email address provided during registration of the cancellation of the order without any charge to the Customer.

Correct receipt of the Order is confirmed by Musto Calzature by means of an email response, sent to the email address provided by the Customer. This confirmation message will briefly report the description of the products purchased, the price and information relating to the order, the data entered by the customer and briefly the conditions of purchase as required by applicable law.

INTELLECTUAL PROPERTY RIGHTS
MUSTOCALZATURE.COM and all related graphic content of the site are the exclusive property of Musto Calzature srl.

This includes, therefore, documentation, images, photos, texts, designs, software, codes and format scripts. Any reproduction, alteration, transmission, publication or redistribution to third parties for commercial purposes is prohibited by the Industrial Property Code, the Copyright Law and the provisions of the Civil Code currently in force and cannot be carried out without the prior written consent of Musto Calzature srl.

ERRORS OR INACCURACIES, DISRUPTIONS, UPDATING OF THE WEBSITE
Musto Calzature srl declines all responsibility for the possibility of any technical or content inaccuracies and/or typographical errors and/or poor service, including those relating to the internet connection or the deactivation of cookies, which depend on factors external to Musto Calzature, without prejudice in any case to the commitment to guarantee the timely restoration of the site or its content.

Musto Calzature srl also declines any responsibility for the possibility that, due to a particular configuration of the computer used by the Customer or a malfunction, the colors of the products displayed on the site present chromatic differences compared to the original ones or the consistency of the fabrics and/or materials with which the articles are made is perceived differently from the original. Musto Calzature, also in order to provide correct and updated information, reserves the right to make corrections and changes to the site whenever necessary. Similarly, Musto Calzature srl reserves the right to modify these general conditions of sale where necessary.

Any changes to the general conditions of sale will be previously reported on the home page of the site and will be automatically applicable to new orders.



PRICES AND PAYMENT METHODS
The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions.

Discounts, vouchers and promotions cannot be combined.

The following payment methods are available:

  1. PayPal
    For payment, the customer can use the Paypal circuit according to the specific methods of the same.
  2. Credit card
    In the case of purchase of goods with Credit Card payment method, the transaction may take place through the secure Paypal server or another secure server chosen by Musto Calzature. In no case and at no stage of the payment will Musto Calzature be able to know the information relating to the Customer's credit card, transmitted via a secure connection directly to the site of the banking institution that manages the transaction. No computer archive of Musto Calzature will store such data and therefore in no case can Musto Calzature be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment.
  3. Wire transfer
    In case of purchase with bank transfer, the bank details for payment will be displayed. The shipment of the goods will take place only upon actual receipt of payment in the bank.
  4. Cash on delivery (only for Italy)
    In case of payment on delivery, the payment must be made exclusively with cash upon delivery of the purchased products. Payment on delivery involves an additional charge of Euro 5 to be paid by the Customer for collection costs. Payment on delivery can only be made for purchases of an amount less than Euro 999.99


DELIVERY OF PRODUCTS TO THE CUSTOMER
The order is processed upon receipt of payment in the case of payment by credit card and advance bank transfer, and upon confirmation of the payment method with cash on delivery. The purchased products will be delivered to the address indicated by the Customer in the Order within 48-72 hours from acceptance of the Order by Musto Calzature, at the cost specifically indicated on the Site before sending the Order. Musto Calzature reserves the right to accept or not requested deliveries outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times are subject to change.

For deliveries requested in countries outside the European Union, any import customs charges will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of his/her country in advance to verify the costs and any import limits.

The delivery times indicated by Musto Calzature must be considered as purely indicative and a delay with respect to the same, or any delivery made with subsequent fractional shipments does not entitle the Customer to refuse the delivery itself and to request compensation or indemnity.

Upon delivery of the products, the Customer is required to check:
that the number of packages delivered corresponds to that indicated in the transport document.
that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps).
Any damage to the packaging and/or the product or any discrepancy in the number of packages or indications must be immediately reported by making a specific note on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods set out in this document.

In the case of payment on delivery, in cash at the time of delivery, the Customer must already have available, in Euros, the exact amount of the Order, including shipping costs and the additional cost foreseen for the chosen delivery method, as also summarized in the order confirmation. The courier will not accept checks, nor will it be able to give change. In the event of a refund, it will still be necessary for the CUSTOMER to have a bank or postal current account.

RIGHT OF WITHDRAWAL
The Customer may return the purchased product without having to specify the reason within 14 (fourteen) working days from the date of receipt of the goods pursuant to art. 52 of Legislative Decree 206/2005 – Consumer Code.

To exercise the right of withdrawal, the customer must send a communication, within the terms indicated above, to the following email address: info@mustocalzature.com

Before shipping the package, you must wait for the email that authorizes the return shipment.

Once authorized, the product must be shipped within 7 working days of receiving the shipping authorization email.

The products must be returned:

Properly packaged in their original packaging, in perfect resale condition (not ruined, damaged or soiled) and equipped with all possible accessories (boxes, bags, laces, shoulder straps etc.)
Intact and without obvious signs of use
With the tag and disposable seal still attached, these elements constitute an integral part of the goods and a return condition.
Shoes must be returned clean, so trying them on a carpet is allowed so as not to ruin the sole. Shoes must be returned without any marks and in their original intact box, as they are an integral part of the shoe itself. Products that are returned with marks, dirt or without a box will not be accepted. The box is an integral part of the product and must arrive intact in all its parts.

The return of products is under the responsibility of the Customer, therefore it is recommended to choose a type of traceable shipment as Musto Calzature is not responsible for any theft, damage or loss. The return shipping costs will be borne by the Customer. The Customer may only use the agreed return for Italy at a cost of €5 which will be deducted from the refund.

The shipment, until it is received in the Musto Calzature store, is under the complete responsibility of the Customer. In the event of damage to the goods during transport, Musto Calzature will notify the Customer, to allow him to promptly file a complaint against the courier and obtain the relevant reimbursement; the product will then be made available to the Customer, simultaneously canceling the request for withdrawal; Musto Calzature will not be liable in any way for damage, theft, loss that occurred during or in any case in dependence on the shipment for the return.

In Italy and abroad, shipping costs for returns are charged to the customer and it is recommended to do so via express courier.

Any additional shipping costs for home delivery of the product (e.g. cash on delivery charges) will not be refunded and therefore remain the responsibility of the Customer.

The refund will be made within 14 working days from the moment we are informed of the Customer's decision to exercise the right of withdrawal, Musto Calzature will refund the Customer the entire amount already paid, net of any shipping costs for the return, pursuant to art. 56, paragraph 2, of Legislative Decree 21/14, through a reversal procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed.

We reserve the right to withhold the refund until the goods arrive at our Store and are verified by our staff.

In any case, the Customer will lose the right of withdrawal in cases where Musto Calzature finds that:

  • the returned product and/or its accessories, and/or its packaging are not intact
  • the product is missing its external packaging and/or the original internal packaging
  • the product is missing integral elements and/or accessories (e.g. laces, buckles, shoulder straps, etc.)

In the event that the returned goods do not comply with the mustocalzature.com return policy and in any case are in a state that does not permit resale, Musto Calzature reserves the right to refuse the Customer's return request by giving specific notice.

Following such communication, the consumer retains the option of re-obtaining, at his own expense, the products in the condition in which they were returned.

Customers who purchase with a VAT number cannot exercise the right of withdrawal.

For non-EU customers, import costs will be deducted from the refund total.

For all aspects not specifically expressed, the European legislation on distance selling shall apply.

WARRANTY
Musto Calzature srl will provide, in relation to the products purchased by the customer, the legal guarantee of conformity to the conditions and terms established by law. In particular, the rights arising from this guarantee may be exercised provided that the products have been used correctly, with due diligence and in compliance with the intended use. Musto Calzature will not consider products damaged due to wear or tear as defective.

All products sold by Musto Calzature srl are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of Legislative Decree 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document. The customer loses the warranty if he does not report the defect within two months from the date on which he discovered the defect.

Musto Calzature, where the existence of the defect is confirmed, will repair or replace the product. If replacement or repair is not possible or excessively expensive, Musto Calzature may proceed with an appropriate reduction in the price paid or reimbursement of a sum commensurate with the value of the goods upon return of the defective product to Musto Calzature.

In the case of defective products, the Customer, without any exception, must:

First of all, send a notification email to Musto Calzature, at info@mustocalzature.com, specifying in the text of the email the order number, the numeric code of the product or products to be returned, the quantities and the reason for the return;
Wait for the email from Musto Calzature with the return authorization number. In the event that the product has defects, Musto Calzature reserves the right to request photographic evidence before authorizing the return.
Prepare the package using the original packaging and follow the instructions in the email authorizing the return.

SHIPPING
Since shipping costs may vary depending on the rates set by the couriers, please refer to the provisions of the “Shipping” link.

Shipping and return costs may exceptionally be borne by Musto Calzature srl where the latter has undertaken occasional promotional campaigns - communicated with specific banners on the site - aimed at reducing or excluding additional costs for buyers. In this case, the provisions of these general conditions regarding the acceptance of shipping or return costs must be considered waived.

APPLICABLE LAW
These general conditions of sale are subject to Italian law and – in the event of disputes regarding their interpretation, application and validity – to the jurisdiction of the judge of the place of residence or domicile of the consumer if resident in Italy.
In all other cases, the dispute will be submitted to the jurisdiction of the Court of Milan, except for the application of the mandatory law and jurisdiction established by the international Treaties and Regulations in force at the time the dispute arises.
